These Terms & Conditions ("Terms") form a binding agreement between you ("you," "Customer") and Leaf Leads, operated by RXR Media LLC, a Wisconsin limited liability company ("Leaf Leads," "we," "us," "our"). By creating an account, placing an order, or using our services through leaf-leads.com, you agree to these Terms. If you do not agree, do not use our services.
1. Service Overview
Leaf Leads provides direct mail fulfillment services for tree service businesses, including design support, printing, USPS Every Door Direct Mail (EDDM) route targeting, postage purchasing, and submission of mail to USPS for delivery. We sell mail fulfillment. We do not sell phone calls, leads, customers, revenue, or business outcomes. All campaign results depend on factors outside our control, including your offer, pricing, market conditions, seasonality, weather, your team's responsiveness to inbound calls, and recipient behavior.
2. Ordering & Payment
All orders are placed through our self-serve portal at leaf-leads.com and require full payment at the time of submission via Stripe, including any installment options offered (such as Klarna or Afterpay). Prices are calculated based on your account's per-flyer rate, the number of residential addresses on the carrier routes you select, your chosen print type (black-and-white or full color), and any applicable add-ons or fees. Prices are subject to change without notice for future orders.
Payment authorization. By submitting an order, you authorize us (and our payment processor) to charge your selected payment method for the full order amount. For installment payments, you authorize the installment provider to charge you according to their terms; chargebacks or disputes with the installment provider do not release you from your obligations to us.
3. Fulfillment & Timeline
We work to fulfill orders within our standard weekly production cadence. Once printed and prepared, flyers are delivered to the designated USPS facility for distribution under the EDDM program. Typical end-to-end time from order submission to mailbox delivery is 7–14 business days, though this is an estimate, not a guarantee. We do not guarantee specific delivery dates or windows.
Once an order has been submitted to USPS, all delivery timing, routing, and per-piece handling is under USPS control. We are not liable for USPS delays, errors, lost mail, mis-delivered mail, weather-related delivery disruptions, postal service work stoppages, or any other USPS-side issues.
4. Artwork, Content & Intellectual Property
You may upload your own artwork or work with us on a custom design. By submitting any artwork, copy, images, logos, offers, business names, claims, certifications, phone numbers, or other content to us, you represent and warrant that:
- You own all rights to the content or have obtained all necessary permissions and licenses to use it;
- The content does not infringe any third party's copyright, trademark, trade dress, publicity, privacy, or other rights;
- The content is not false, deceptive, defamatory, or misleading, and complies with all applicable laws including consumer protection and advertising laws;
- Any certifications, licenses, awards, or affiliations referenced are accurate and current; and
- You have the right to use any phone numbers, addresses, or contact information shown.
Indemnification. You agree to defend, indemnify, and hold harmless Leaf Leads, RXR Media LLC, and our employees, contractors, owners, and affiliates from any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your artwork or content; (b) your business practices or services offered to recipients of your mailers; (c) any claim by a recipient of your mailer; or (d) your violation of these Terms.
Right to refuse. We may refuse to print or mail any content that we believe is unlawful, infringing, deceptive, defamatory, sexually explicit, hateful, or otherwise inappropriate, in our sole discretion. If we refuse content after an order is placed, we will offer you the option to substitute compliant content or receive a refund of amounts not yet spent on production or postage.
5. Route Selection & Targeting
Carrier route data is sourced from USPS and is subject to change. Residential and business address counts shown in our portal are estimates provided by USPS and may vary from actual delivery counts. We fulfill orders based on the routes selected at the time of order submission. Actual flyer counts may be adjusted up or down to match USPS route requirements at the time of mailing, and pricing may be reconciled accordingly. We are not responsible for variations in counts within the range typical for EDDM mailings.
6. Cancellations & Refunds
Production-status cancellations. An order may be cancelled for a full refund only if cancellation is requested before any of the following has occurred: (i) artwork has been sent to a printer or design vendor; (ii) postage has been purchased; or (iii) flyers have entered our prep, print, or mail queue. To request a cancellation, email hello@leaf-leads.com as soon as possible after placing the order.
After production has begun. Once any production step has been initiated, the order cannot be cancelled and no refund is owed for the work performed or costs incurred. We may, at our discretion and as a customer-service gesture, offer a partial credit toward a future order.
No refunds for results. Refunds are never owed based on the performance of a mailer (number of phone calls, leads, jobs sold, ROI, response rate, or any other business outcome). Mailer performance depends on factors outside our control. See Section 8.
7. Chargebacks
If you have a concern about an order, you agree to contact us first at hello@leaf-leads.com and give us a reasonable opportunity to resolve the issue before disputing the charge with your bank, card issuer, or installment provider.
Filing a chargeback or payment dispute without first contacting us in good faith constitutes a material breach of these Terms. In that event, you agree that (i) any pending refund request is forfeited; (ii) you are responsible for any chargeback fees, processing fees, and reasonable costs of dispute (including time spent assembling evidence and reasonable attorneys' fees); and (iii) we may suspend or terminate your account.
8. No Guarantee of Results; Limitation of Liability
No performance guarantee. We make no representations or warranties about the number of phone calls, leads, customers, jobs, revenue, response rate, or return on investment you will receive from any mailer. Direct mail is one input in a larger sales process that includes your offer, pricing, the quality of your follow-up, your market, season, and many other factors we do not control. Past results, sample numbers, examples, or testimonials are not predictive of your results.
Service is provided "as is." To the maximum extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Liability cap. Our total aggregate liability to you arising out of or related to these Terms or our services, for any cause and under any theory (contract, tort, statute, or otherwise), is capped at the lesser of (a) the amount you paid us for the specific order giving rise to the claim, or (b) the amount you paid us in the 30 days preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost leads, lost business opportunity, loss of goodwill, or business interruption, even if advised of the possibility. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
9. Account, Data & Communications
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We store your order history, selected routes, uploaded artwork, contact information, and business information to provide our services. We do not sell your personal data to third parties. By creating an account or placing an order, you consent to receive transactional and service-related emails from us at the email address you provide. You may receive marketing communications, which you may opt out of at any time using the unsubscribe link or by contacting us.
10. Force Majeure
We are not liable for any delay or failure to perform caused by events outside our reasonable control, including but not limited to: acts of God, severe weather, natural disasters, fire, flood, pandemic, governmental action, labor disputes or work stoppages, USPS service disruptions, supply shortages affecting paper or printing materials, internet or utility outages, payment processor outages, or failures of third-party vendors. If such an event causes a material delay, we will work in good faith to fulfill the order as soon as reasonably practicable.
11. Governing Law & Venue
These Terms and any dispute arising out of or relating to them or our services are governed by the laws of the State of Wisconsin, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You and we agree that any lawsuit, claim, or proceeding arising out of or relating to these Terms or our services must be brought exclusively in the state or federal courts located in Brown County, Wisconsin, and you consent to the personal jurisdiction of those courts. You waive any objection based on inconvenient forum.
12. Termination & Suspension
We may suspend or terminate your access to the platform, in whole or in part, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraud or chargeback abuse, submitted unlawful or infringing content, or pose a risk to us or our customers. You may close your account at any time by contacting hello@leaf-leads.com. Sections that by their nature should survive termination (including Sections 4 indemnification, 6 no-refunds-for-results, 7 chargebacks, 8 limitation of liability, 11 governing law and venue, and this Section 12) will survive.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where reasonable, notify registered users by email. Continued use of the platform after the update takes effect constitutes acceptance of the updated Terms. If you do not agree with a change, your sole remedy is to stop using the platform and close your account.
14. Miscellaneous
Entire agreement. These Terms, together with any order confirmations and the Privacy Policy, are the entire agreement between you and us regarding our services and supersede any prior agreements or communications.
Severability. If any part of these Terms is held invalid or unenforceable, the rest remain in effect, and the invalid part will be modified to the minimum extent necessary to make it enforceable and reflect the parties' intent.
No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms or your account without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
No third-party beneficiaries. These Terms are between you and us only. Recipients of your mailers, your customers, and other third parties have no rights under these Terms.
